The Growing Use and Abuse of State Consumer Protection Laws

Increasingly, plaintiffs’ attorneys have been filing suits under state consumer protection acts. These state consumer fraud statutes often lack key safeguards present in the traditional common law of torts, including the requirement that jurors find actual injury to the plaintiff. Our distinguished panelists will shed light on whether these lawsuits help consumers by deterring fraud—or whether they are a fraud on the consumer.
